“Notary Public: Voluntary Jurisdiction” is the title of the new book presented by Dr. Maribel Martínez Calderón which offers a rigorously- organized, schematic and detailed explanation of the information, criteria and analysis on the voluntary jurisdiction applied to this legal activity.


Dr. Martínez, an alumnus of the Law School of the Autonomous University of Santo Domingo, was a coordinating member of the Judicial Vision movement, President of Disciplinary Tribunal of the Association of Dominican Lawyers,


The launching of this informative book, which took place in the auditorium of the Supreme Court of Justice, was headed by Alejandro Moscoso Segarra, District Attorney of Santo Domingo; Lino Vásquez Samuel, Commissioner of Support for the Reform and Modernization of the Justice System; Rafael Ciprián, Judge in the Upper Court of Land Issues who wrote the book´s prologue; Luis Vílchez Marranzini, President of the Dominican Notary College and the author of the book, Maribel Martínez Calderón.


Dr. Martínez, an alumnus of the Law School of the Autonomous University of Santo Domingo, was a coordinating member of the Judicial Vision movement, President of Disciplinary Tribunal of the Association of Dominican Lawyers, assistant to the State Attorney before the Land Tribunal, legal consultant for the Dominican Corporation of State Companies and is currently the legal advisor for the Patrimonial Fund of the Reformed Company (FONPER).


The 126-page book contains a series of topics on the legal framework of voluntary jurisdiction, countries that maintain the system, the challenge of organizational and traditional culture, the demand for implementation of a voluntary jurisdiction, the role of the Supreme Court and the Dominican Notary College, among other topics.


Ms. Martínez said that in recent decades, the majority of countries who make up the International Union of Latin Notaries have undergone big structural changes as well as shifts in existing notarial legislation.


The reforms, transformations and modernizations have often been motivated by individuals while others have been introduced by the state into the justice system, in the form of norms as well as laws.


This book is a reflection of society and attempt to put into practice a useful, although relatively unknown, notarial instrument.


According to the book, this legal process known as voluntary jurisdiction is a mechanism that can be used by parties who mutually seek to legalize an agreement, document or issue of a non-contentious procedure such as resolving questions that have been previously agreed upon by both parties.


Martínez estimates that the DR is in an adequate position to promote such reforms in the Dominican notary code insofar as it coincides with the constitutional reform that is currently being sought by Dominican society.
